HC issues rule on Govt: Emergency Powers Rules challenged

A High Court Division Bench of the Supreme Court yesterday questioned the legitimacy of some provisions of Emergency Power Rules (EPR) and issued a rule upon the Government to explain within eight weeks as to why the provisions concerned should not be declared ultra vires of the Constitution. The bench, comprising Justice Shah Abu Nayeem Mominur Rahman and
Justice Zubayer Rahman Chowdhury, after preliminary hearing of a writ petition, yesterday issued rule upon government to explain why the provisions of the EPR cited in the petition should not be declared ultra vires of the fundamental rights enshrined in the Constitution. [Read more]
